Terms of Service

These terms apply when you use the free rent check or buy an Evidence Pack or a Landlord Evidence Report.

What UpRently does

UpRently compares a proposed rent with published evidence about rents for similar homes in the same local area, and reports how the two compare. The free check gives you that result on screen. The Evidence Pack, or for landlords the Landlord Evidence Report, is a PDF setting out the same result together with the comparable evidence, the evidence strength rating and the method used. Both cost the same, and the rest of these terms call both of them the Evidence Pack.

What UpRently is not

This is important, so it is set out plainly. UpRently:

  • is not legal advice, and we are not a firm of solicitors
  • does not check whether a notice you have received is valid
  • is not a tribunal submission and is not filed with anyone on your behalf
  • does not guarantee any outcome, at tribunal or otherwise

Your responsibilities and ours

You are responsible for:

  • entering the right figures, which means the current rent, the proposed rent, the postcode, the property type and the number of bedrooms
  • entering the dates as they appear on your notice or your tenancy agreement
  • checking that the Evidence Pack describes the right home before you rely on it
  • deciding what to do with the result, which is information rather than advice

We are responsible for:

  • performing the comparison correctly on the figures you enter
  • saying where the evidence came from and the date we retrieved it
  • saying when the evidence is thin or far away, rather than dressing it up
  • delivering the Evidence Pack you paid for, and refunding you if we cannot

A result based on incorrect details will itself be incorrect. That is not a fault in the service, and it is why the free result echoes your answers back to you before you buy anything.

Accuracy of the data

The comparable homes come from PropertyData, our market-data provider, which collects recent lettings advertised on the main property websites. Every Evidence Pack states which source produced its figures and on what date.

These are advertised rents, not rents we know were agreed. They are general information to help you compare, not a valuation and not advice. They may not reflect the condition, fixtures, floor area or exact location of any individual home, and rents change over time. Neither PropertyData nor the property websites has checked or endorsed anything we show you. Check anything you intend to rely on, and where too few comparable homes are available we say so rather than give a result.

Eligibility and scope

UpRently covers England only. Scotland, Wales and Northern Ireland have different renting laws and are not supported. You must be 18 or over to buy an Evidence Pack.

Price and payment

The Evidence Pack costs £19.99. That is the total you pay. It is a one-off payment, with no subscription and no recurring charge. We are not registered for VAT, so no VAT is charged.

Payment is taken by Stripe. You enter your card details into Stripe’s own form, and they are never sent to us or stored by us. We receive confirmation that the payment succeeded, the amount, and the email address you used, so that we can send you the pack.

Before you pay, we ask you to confirm that you want the pack sent to you immediately and that you understand this ends the usual 14-day right to cancel. We cannot take payment without that confirmation, and we record it against your order.

Delivery

Your Evidence Pack is emailed to the address you give at checkout, normally within a few minutes of payment. If it has not arrived within an hour, check your junk folder and then tell us using our contact form and we will resend it. The times we work to are listed below.

Cancellation and refunds

The Evidence Pack is digital content delivered immediately. Our Refund and Cancellation Policy explains how the 14-day cancellation right applies and when we refund you anyway.

Acceptable use

You may use the checker for genuine enquiries about a property you rent, let or are considering. You must not use automated means to submit checks at volume, attempt to interfere with the service, or resell access to it. We limit how many checks one visitor can run in a short time, and we may block use that appears automated or abusive.

What the file is, and what you need to open it

The Evidence Pack is a single PDF document, normally five to seven pages, sent as an attachment and also available to download from the confirmation page for seven days. There is no copy protection on it and no software to install. It opens in any PDF reader, including the one built into every current web browser, phone and computer. It is a fixed document rather than a live service. The figures in it are the figures as at the date printed on it, and it does not update afterwards.

Your Evidence Pack

You may keep, print and share your own Evidence Pack, including with your landlord, your tenant, an adviser or a tribunal. You may not present it as the work of anyone other than UpRently, alter its figures, or republish it commercially.

You may not take the comparable listings out of it to build, publish or sell a dataset, feed or list of your own. That restriction comes from our data provider’s licence, and it applies to you as it applies to us.

Every time we commit to anywhere on this site is listed here, so there is one place to check us against. Working days are Monday to Friday, not including bank holidays in England. If we are going to miss one of these, we will tell you.

Liability

We provide the service with reasonable care and skill. We are not liable for any decision you take in reliance on a result, for the outcome of any negotiation or tribunal application, or for losses that were not reasonably foreseeable. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Your statutory rights as a consumer are unaffected.

Where we are liable, our total liability for any claim relating to an Evidence Pack is limited to the amount you paid for it. That cap does not apply to your remedies under the Consumer Rights Act 2015 if the pack is not of satisfactory quality, not fit for purpose or not as described, and it does not apply to a refund we owe you under the Consumer Contracts Regulations 2013.

Changes

We may update these terms. The version published when you make a purchase is the version that applies to it.

Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.

If you live in Scotland or in Northern Ireland, you keep the right to bring proceedings in the courts where you live, and the law that protects consumers where you live still applies to you. Nothing in this section takes that away.

Complaints

Send us your complaint and we will respond within five working days. Tell us your order reference if you have one.

We are not a member of an alternative dispute resolution scheme, and we do not currently offer to take unresolved complaints to one. That does not affect your legal rights. If we cannot settle a complaint between us, you are free to take the matter to court.
